Optical Express is considering an appeal after it was ordered to pay one of its customers £500,000 in damages.

A 28 year old woman has successfully brought a claim against Optical Express.  She alleged that she had not been properly warned about the risks of the procedure before it was performed.

Judge Edward Baily found that there was “absolutely no way” Miss Holloway had been properly informed of the risks and possible complications associated with the surgery.  Unusually, it was found that the surgery had been performed to a reasonable standard- Miss Holloway’s reduced vision and photophobia recognised risks of the procedure.  However, she was successful because it was found that she could not have been adequately informed of the risks in a three minute consultation, and having been given the consent form an hour before her procedure.
