Howells client, “KL” was a vulnerable male with a long history of mental ill-health. In July 2014, following concerns raised about his behaviour, police attended and he was arrested and detained.

The level of force used in restraining KL at the police station was excessive, with one officer being charged with assault. The officer’s criminal conviction was successfully appealed – a matter of disappointment for KL who above all else wanted the officers held to account and for lessons to be learnt.

There was an excessive and inappropriate use of CS Gas and KL’s skin blistered and burnt.

KL’s arrest and detention was in the circumstances unlawful.

It has taken a number years and required a lot of commitment by KL to pursue his claim and obtain justice. Howells solicitor Kulvinder Gill has had conduct of the case and says:

“It has been a pleasure to work with KL and secure an outcome with which he is happy. Damages claims against the police can be difficult and but for the CCTV footage showing the excessive force used within the police station the outcome may have been different. It is a credit to him that he has continued to fight and pursue his claim despite set backs with the outcome of the police complaint and criminal trial against one of the officers.”
