Six-figure sum for delay in diagnosis and treatment of Howells Client

Howells have successfully obtained a six-figure sum for a client who suffered injuries from a delay in diagnosis and treatment of Cauda Equina Syndrome (CES). CES is a rare disorder where something compresses on the spinal nerve roots. These nerves are located at the lower end of the spinal cord in the spine. They send and receive messages to and from your legs, feet, and pelvic organs.

On 1 March 2010 our client attended the Accident & Emergency (A&E) Department at the Northern General Hospital (NGH) complaining of severe back pain. He was diagnosed with a suspected musculo-skeletal condition when in fact he had developed CES. He was sent home where his condition deteriorated until he was eventually diagnosed on 4 March 2010. He underwent major spinal surgery and spent 6 weeks in hospital.

We argued that there was a negligent delay in the diagnosis of our client’s condition. The negligence treatment was based on the deficient examination, the lack of specialist input and the inadequate history-taking.

The Defendant admitted that our client should not have been sent home and that he should have been investigated further.

A six-figure sum was successfully agreed which significantly assisted our client who remained severely disabled and in need of substantial levels of care and personal support.
