Successful outcome for Clinical Negligence client following injury during labour

Howells have negotiated a significant sum for a client who experienced a delay in identification and treatment of a birth injury. This involved a third degree tear during our client’s first labour.

After labour and delivery, our client had a terrible time in hospital and was discharged without the injury being identified or treated. She had to return very soon thereafter unfortunately.

Once the injury was identified, the client was initially persuaded not to have surgical repair. Eventually however, her symptoms were too great and she underwent the repair she needed. This time in hospital however, while trying to care for a new-born, left her very badly affected.

We argued that there had been a negligent failure to identify and treat the injury. This was admitted and a substantial settlement was eventually agreed. This will allow our client to access the best quality care she may need for both her physical and psychological injuries.

Report shows women are twice as likely to suffer serious injuries during childbirth in some hospitals. Women affected by third and fourth degree tears varied between 6.5% of women in one hospital, compared to 0.6% at another.
