She has dealt with a wide range of clinical negligence cases that have arisen out of treatment received from GP’s, dentists, opticians, pharmacy’s, walk in centres and hospitals.
Michelle specialises in complex clinical negligence cases in which clients have often suffered life changing injuries as well as the families of those who have suffered the loss of a loved one as a result of a medical accident. She also acts for patients and minors who are incapable for bringing a claim on their own behalf.
She has practiced in Barnsley and Sheffield throughout her career and is well known in the South Yorkshire area.
“I have found staff at Howells very professional and kind and understanding. The solicitors are very professional and kind. Also always keep you up to date with everything that’s happened with one’s case. Nicola Mosley and Michelle Gyte have been top notch in everything they do. I can never thank Howells and staff enough for taking my case on when other law firms were pretty poor. Thank you to all staff at Howells.” – John Bloodworth
“This was a case where there were litigation risks and that a discount was appropriate. The proposed order was good and accurate and a sensible way to deal with the case. It seems to be a complex clinical negligence case where it is important that the parties’ legal representatives have plainly identified the risks to both parties. The proposed order accurately and sensibly reflects the risks. The parties are to be commended for diligence and common sense and it is hoped that the matter can proceed to an award of damages for the claimant and rescheduled in due course.” – HHJ Gargan
A six-figure sum was successfully agreed on behalf of a client who lacked capacity to handle his own affairs arising out of a complex delay in diagnosis of cauda equina case. The damages has significantly assisted the client who remained severely disabled and in need of substantial levels of care and personal support. The family of Michelle’s client commented:
‘We would like to express our gratitude and thanks to Howell's solicitors. We are extremely impressed with their thorough and in depth knowledge of our case. Your expertise and friendly service has helped us to get through the last 7 years. We are delighted with the service we have received and over the moon with the outcome of the claim. We can now look forwards to a brighter future.’
Michelle is ranked in both in the Legal 500 and Chambers UK in relation to her work conducted on behalf of clinical negligence clients.
The Chambers and Partners Guide to the Legal Profession (2019) name Michelle as a Star Associate and says “Michelle Gyte is well regarded in the clinical negligence field. She advises on claims arising from delays in the diagnosis and treatment of cancer and other conditions. She also acts on cauda equina syndrome cases and fatality claims.”
The Legal 500 2018 states “Howells is recognised for its 'longstanding experience in the field' of clinical negligence and its 'personal attention to clients'. The practice has expertise in niche claims such as those relating to prison healthcare, walk in centres, provision of mental health care and human rights considerations. The team also handles wrongful birth claims, delayed and misdiagnosis of cancer, substandard orthopaedic surgery claims as well as representing clients at inquests. In addition, it is one of the few practices with a legal aid agency clinical negligence franchise. The 'very experienced claimant clinical negligence solicitor' Michelle Gyte is singled out for having 'managed many high value claims'.”
