Assault & Battery by Police

Assault & Battery by Police

The police have the authority to use physical force in certain circumstances, such as self-defence. Reasonable force can also be used during the course of an arrest, but if the arrest is unlawful, then the police may have committed an assault or battery against you.

However police officers can only use physical force against you if it is reasonable. Even if the police have a lawful excuse for making physical contact with you, the force used may still amount to a battery if the level of force used was unreasonable. This depends upon the particular circumstances of the situation.

If you were wrongly arrested, you will have a claim for compensation for any unlawful touching or assault by the police including the application of handcuffs and the taking of your fingerprints and DNA.

Whilst you may feel that you are powerless against the police, you have the right to justice as you would if you had been wronged or assaulted by any other authority.
